By accessing, browsing, or utilizing the services of PropSeek Realty ("PropSeek", "we", "our", "us") through propseek.in or via direct communication with our representatives, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
2. Nature of Services
PropSeek Realty operates as an authorized real estate marketing consultancy, channel partner, and advisory firm. We facilitate introductions, property exploration, scheduled site visits, developer negotiations, and information sharing between prospective buyers and reputed real estate builders.
We are not developers, builders, or sellers in our own capacity. The actual contract of sale, allotment letter, conveyance deed, or agreement for sale is executed directly between you (the buyer) and the respective project developer.
3. Information Accuracy & Project Data
While we exercise reasonable care and due diligence to verify property listings, specifications, prices, dimensions, and possession timelines from developer brochures and official RERA public filings:
- Property details, floor plans, pricing bands, and availability are subject to periodic modifications by developers without prior notice.
- Images, 3D architectural renders, layout visuals, and walkthroughs are artistic impressions intended for visual orientation only.
- Actual carpet area, finishing standards, and amenities will be strictly governed by the registered Agreement for Sale with the developer.
4. Independent Due Diligence
Property investment involves legal and financial commitments. We strongly advise all prospective buyers to:
- Verify the official project registration on the state RERA portal (e.g., rera.wb.gov.in).
- Seek independent legal review of the title deeds, sanctioned building plans, and developer agreements prior to executing any financial transaction.
- Verify home loan eligibility and bank approval terms independently.
5. Intellectual Property
All branding, text, code, logos, icons, and proprietary compilations displayed on PropSeek Realty are the intellectual property of PropSeek Realty or licensed by respective developers. Unauthorized reproduction, copying, or redistribution without written consent is strictly prohibited.
6. Limitation of Liability
To the fullest extent permitted under applicable law, PropSeek Realty and its directors, consultants, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from changes in developer pricing, project delays, construction variations, or disputes between buyers and developers.
7. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts in Kolkata, West Bengal.
